1. Introduction & Acceptance of Terms

Welcome to Uncook ("we," "our," "us," or the "Company"). These Terms and Conditions (the "Terms") govern your use of the Uncook mobile application (the "App") and all associated services. By creating an account on Uncook or using the App in any way, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Acceptance During Registration

During profile creation, you will be asked to verify your age and accept these Terms and our Privacy Policy. You must affirmatively accept both documents by selecting "I Accept" or similar confirmation before your account is activated. These acceptances are conditions of using the App.

Acceptance Upon Updates

We may update these Terms at any time by posting the updated version on the App or notifying you of significant changes via email. If we make material changes to these Terms, we will require you to affirmatively accept the updated version on your next login. You cannot use the App until you accept the updated Terms. Similarly, if we update our Privacy Policy materially, we will require separate acceptance of the updated Privacy Policy before you can continue using the App. Your continued use of the App following acceptance of updated Terms or Privacy Policy constitutes your ongoing agreement to them.

We recommend reviewing these Terms periodically to stay informed of any changes.

2. Eligibility & Account Registration

2.1 Age Requirement

You must be at least 18 years old to create an account and use Uncook. By registering, you represent that you are 18 or older and have the legal capacity to enter into this agreement.

Age Verification: We rely on you to provide accurate age information during account registration. We do not verify ages through ID checks or third-party verification services. If you provide false age information, your account will be deleted upon discovery.

Consequences of Misrepresentation: If we discover that an account belongs to a user under 18, we will immediately delete the account and all associated data.

2.2 Account Registration

To use the App, you must create a personal account by providing accurate, current, and complete information. You agree to:

3. User-Generated Content

3.1 Content Ownership & License Grant

You retain ownership of all content you create and post on Uncook, including recipes, photos, videos, comments, and other contributions (collectively, "Your Content").

However, by posting Your Content to Uncook, you grant us a perpetual, irrevocable, worldwide, royalty-free, non-exclusive, sublicensable, and transferable license to:

This license survives indefinitely for all lawful content. However, if your content is determined to infringe copyright or violate these Terms, the license terminates immediately and we will not use, display, reproduce, or distribute that content.

You agree not to post, share, or engage in any of the following on Uncook:

  1. Illegal content: Content that violates any applicable law, regulation, or court order
  2. Infringing content: Content that infringes copyright, trademark, patent, or other intellectual property rights
  3. Harmful content: Content that is threatening, harassing, abusive, defamatory, hateful, discriminatory, or otherwise harmful to individuals or groups
  4. Misleading or fraudulent content: False, deceptive, or fraudulent recipes, claims, or information
  5. Spam: Unwanted, repetitive content, promotional content, or unauthorized advertising
  6. Privacy violations: Content that discloses private information about others without consent
  7. Illegal drug promotion: Content glorifying illegal drug use or providing instructions for illegal drug preparation or consumption

5. Content Moderation & Enforcement

5.1 Reporting System

We provide tools for you to report content, users, or behaviors that violate these Terms. You may report:

5.2 Enforcement Actions & Tiered Violation System

We enforce our policies consistently through a tiered system that balances flexibility with fairness.

TIER 1 VIOLATIONS (Minor) - Always Three-Strike Process: These violations trigger our standard three-strike enforcement process:

TIER 2 VIOLATIONS (Moderate) - Discretionary Enforcement: We may skip the three-strike process and proceed directly to suspension or termination based on severity:

Process: Warning, or immediate 7-day to permanent suspension at our discretion depending on severity and context

TIER 3 VIOLATIONS (Severe) - Immediate Permanent Ban: These violations result in immediate, permanent account termination with no warnings:

Process: Immediate permanent ban. Content is removed and reported to law enforcement as required by law.

Ban Circumvention: Attempting to circumvent a suspension or ban by creating new accounts will result in immediate termination of all accounts and permanent platform ban.

Reporting System Abuse: Misuse of the reporting system (false reports, harassment through reports, etc.) may result in suspension or termination of your account.

Determination of Tier: We determine which tier applies based on context, severity, and user history. We will provide notice of the tier designation when taking enforcement action.

6. AI Assistant

6.1 Features & Limitations

Uncook includes an optional AI-powered assistant that provides cooking tips, recipe recommendations, ingredient substitutions, and other cooking-related guidance (the "AI Assistant"). The AI Assistant:

Important: The guidance provided by the AI Assistant is for informational and entertainment purposes only. You use the AI Assistant at your own risk.

The AI Assistant's recommendations are NOT:

We do not guarantee the accuracy, completeness, safety, or appropriateness of any advice from the AI Assistant. You are solely responsible for evaluating the AI Assistant's recommendations and determining whether they are appropriate for your situation.

You assume all risk associated with following any recommendations from the AI Assistant, including risks of foodborne illness, allergic reactions, injuries, or adverse health effects.


7. Intellectual Property

Uncook owns and retains all rights to the App, website, and all associated intellectual property, including:

9. Advertising

Uncook is a free platform supported by advertising revenue.

Advertising on Uncook:

By using Uncook, you acknowledge and accept that advertising is a core part of the platform and a condition of free use. Ad-free subscription tiers may be available in the future.


10. Subscriptions & Payments

In the future, we may offer paid subscription tiers that provide additional features, such as ad-free browsing. Terms for subscriptions, including pricing, billing cycles, cancellation, and refund policies, will be provided separately when subscription options become available.


11. Disclaimers & Limitation of Liability

11.1 Platform "As Is"

The Uncook App and all content on it are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including:

We are not responsible for the accuracy, legality, appropriateness, or quality of any user-generated content posted on Uncook. You rely on user-generated content at your own risk.

11.3 No Liability for Adverse Outcomes

We are not liable for any adverse outcomes, injuries, illness, or damages resulting from:

11.4 Limitation of Damages

To the fullest extent permitted by applicable law, Uncook's total liability to you for any damages, losses, or claims arising from your use of the App shall not exceed the total amount you have paid to Uncook in the 12 months preceding the claim (or $100, whichever is greater). This limitation applies regardless of the legal theory (contract, tort, etc.) on which the claim is based.

Some jurisdictions do not allow limitations on liability for personal injury or gross negligence. In such cases, this limitation will be modified to the maximum extent permitted by law.


12. Indemnification

You agree to indemnify, defend, and hold harmless Uncook, its owners, employees, agents, and representatives from any and all claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

  1. Your violation of these Terms
  2. Your use of the App in violation of applicable law
  3. Your User Content, including claims that it infringes third-party rights
  4. Your violation of any third party's intellectual property, privacy, or other legal rights
  5. Any disputes between you and another user

13. Termination

13.1 Account Deletion by Users

You may delete your Uncook account at any time by visiting your account settings and selecting the delete account option. Upon account deletion:

Your Rights: If you are a California resident, this deletion process satisfies your "Right to Delete" under the California Consumer Privacy Act because your personal information is removed from your content. Once anonymized, the content is no longer identifiable as yours.

13.2 Suspension or Termination by Uncook

We enforce account suspensions and terminations according to our tiered violation system (see Section 5.2 for details).

14. Dispute Resolution

14.1 Governing Law

These Terms and your use of Uncook shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. You agree that Delaware law will apply even if you are located in another jurisdiction.

14.2 Mandatory Arbitration

Any dispute, claim, or controversy arising from or relating to these Terms, your use of the App, or your relationship with Uncook (including contract disputes, tort claims, statutory claims, and consumer claims) shall be resolved by binding arbitration, not in court. This includes claims you might otherwise bring in small claims court.

Arbitration Process:

Exceptions: This arbitration clause does not apply to claims for injunctive relief seeking to prevent intellectual property infringement or claims for small amounts in small claims court.

14.3 Class Action Waiver

You and Uncook agree that all arbitration claims must be brought in your individual capacity and not as part of any class action, class arbitration, or representative proceeding. You waive the right to participate in any class action lawsuit or arbitration against Uncook.


15. Miscellaneous

15.1 Severability

If any provision of these Terms is found to be invalid or unenforceable by a court or arbitrator, that provision shall be modified to the minimum extent necessary to make it enforceable, or if not possible, severed from these Terms. The remaining provisions shall remain in full force and effect.

15.2 Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Uncook regarding your use of the App and supersede all prior and contemporaneous negotiations, understandings, and agreements, whether written or oral.

15.3 Waiver

Uncook's failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by an authorized representative of Uncook.

15.4 Assignment

You may not assign or transfer these Terms or your rights under them to any third party without Uncook's prior written consent. Uncook may assign these Terms at any time without notice. Any attempted assignment in violation of this provision is void.

15.6 Updates to These Terms

We may update these Terms at any time. The "Effective Date" at the top of this document indicates when these Terms were last revised. Your continued use of the App after any changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.
